Privacy and data protection

izmigo Privacy Policy

This policy explains which personal data Berlin GmbH LLC processes when passengers, drivers and website visitors use izmigo, why we process it, who receives it and which rights you have under the Turkish Personal Data Protection Law (Kişisel Verilerin Korunması Kanunu, Law No. 6698). It applies together with the Terms of Use.

izmigo is a taxi request platform for İzmir. We connect you with licensed taxis; we do not carry you and we do not handle the fare. Location is processed only while you prepare and send a request and while an accepted ride is in progress. You can ask for access, rectification, erasure or a copy of your data at any time by e-mail.

1. Who is responsible

The data controller (veri sorumlusu) is Berlin GmbH LLC (berlingmbh.com), which operates izmigo, the driver app izmigo partner and the website izmigo.com. You can reach us for any data protection matter at the support address at the end of this page.

izmigo is a digital platform on which passengers publish taxi requests and nearby licensed taxi drivers may accept them. Berlin GmbH LLC does not carry passengers, does not employ drivers and does not collect or process the ride fare.

2. Data we process

We collect only what is needed to create your account, publish a request and put you in contact with the driver who accepts it.

  • Account data: name, mobile phone number, verification code status and, if you add one, an e-mail address or profile photo.
  • Location data: your GPS position while you set the pickup point and send a request, and during an accepted ride so that the driver can find you. Location is not tracked in the background outside these moments.
  • Request data: pickup point, destination, searched addresses, route, approximate fare, time of the request and its outcome (accepted, cancelled, completed).
  • Device and technical data: device model, operating system, app version, language, push notification token, IP address and error logs.
  • Driver data (izmigo partner only): taxi operating licence and plate details, vehicle make and model, driving licence, working position while online and membership payment records.
  • Support data: the content of e-mails you send us and the details you include in them.

3. Why we process it and on what legal basis

We process data to run your account, verify your phone number, publish your request to nearby drivers, show route and tariff information, send notifications about the state of a request, answer support messages and prevent fraud and misuse.

The legal bases are set out in Article 5 of Law No. 6698: processing that is directly related to the conclusion or performance of our contract with you (Art. 5(2)(c)); your explicit consent for optional permissions such as location and push notifications (Art. 5(1)); our legitimate interests in keeping the platform secure and free of abuse, provided your fundamental rights are not harmed (Art. 5(2)(f)); and our legal obligations in tax and accounting matters for driver membership records (Art. 5(2)(ç)).

4. What passengers and drivers see about each other

While a request is open, nearby drivers see the pickup point, destination and approximate fare, but not who you are. When a driver accepts, that driver sees your name and phone number and you see the driver's name, phone number, vehicle and position.

Passengers and drivers may contact each other directly by phone or messaging to confirm details. Those conversations take place outside the app and are not stored by us.

5. Third parties and transfers abroad

We share data only with providers that are needed to run the service and only to the extent necessary: hosting and infrastructure, map, routing and address search providers, SMS or voice providers that deliver verification codes, and the Apple and Google services that deliver push notifications.

Some of these providers operate servers outside Türkiye, so running the service involves transferring personal data abroad. Such transfers are made under Article 9 of Law No. 6698: on the basis of an adequacy decision of the Personal Data Protection Board where one exists, otherwise on the basis of an appropriate safeguard such as a standard contract, binding corporate rules or a written undertaking, and failing that only in the exceptional cases the Article permits.

We do not sell personal data and we do not use it for third-party advertising. We disclose data to public authorities only when a law, court order or binding request from a competent authority requires it.

6. How long we keep data

Account data is kept while your account is active. Request history is kept for 24 months to handle disputes and is then anonymised. Positions sent during a ride are deleted or anonymised within 90 days. Technical logs are kept for up to 12 months.

When you delete your account, personal data is erased or anonymised within 30 days, except for records we must keep under tax, accounting or statute-of-limitation rules, which are kept for the period required by law and then deleted.

7. Your rights and how to use them

Article 11 of Law No. 6698 gives you the right to learn whether your personal data is processed and to request information if it is; to learn the purpose of processing and whether the data is used accordingly; to know the third parties in Türkiye or abroad to whom it is transferred; to request correction of incomplete or incorrect data; to request its erasure or destruction; to request that any correction or erasure be notified to those third parties; to object to a result produced solely by automated analysis; and to claim compensation for damage caused by unlawful processing.

To use a right, write to the support address below from the e-mail address or phone number linked to your account. Under Article 13 we answer free of charge and at the latest within thirty days. A fee from the Board's tariff may apply only where the request genuinely creates an additional cost.

If you are not satisfied with our answer, or if we do not reply, Article 14 lets you complain to the Personal Data Protection Board (Kişisel Verileri Koruma Kurulu) within thirty days of learning our answer and in any event within sixty days of your application to us. You must apply to us first; a complaint cannot be made before that route is exhausted. Complaints are filed through the Personal Data Protection Authority (Kişisel Verileri Koruma Kurumu) at kvkk.gov.tr, including its online complaint module.

8. Children

izmigo is intended for people aged 18 or over. We do not knowingly create accounts for minors; if we learn that an account belongs to a child we delete it.

9. Security

Data is transmitted over encrypted connections and stored on access-controlled systems. Access inside Berlin GmbH LLC is limited to staff who need it for support and operations. No system is completely secure; if a breach affects your rights we will inform you and the Personal Data Protection Board as Article 12 of Law No. 6698 requires.

10. Changes

We may update this policy when the service, the law or our providers change. The current version is always published in the app and on izmigo.com with its date. If a change materially affects you, we will notify you in the app before it takes effect.
